Terms and Conditions
“PLEASE READ THE TERMS AND CONDITIONS CAREFULLY AS YOU WILL BE BOUND BY THEM”
(a) Your contract is with Tune Hotels Sdn Bhd trading as Tune Hotels.Com. These are the general terms and conditions that apply to your contract with Tune Hotels.Com and are supplemented by the terms and conditions that
apply to the specific Tune Hotels.Com where you have booked to stay (together "the Terms & Conditions" therein). Usage of this website is on condition that you accept without variation the terms and conditions set out herein
which Tune Hotels.Com may vary from time to time at its sole discretion with/without notice to you and you acknowledge that the usage of this website constitutes your agreement to all the terms and conditions in force for the
time being as set out herein.
(b) In the Terms & Conditions: "we" or "us" or “Hotel” means Tune Hotels.Com (including, where appropriate, our employees, agents, and suppliers and all relevant insurers); "you" or “guests” means any and all person
(s) for whom a hotel room is booked.
(c) The following terms and conditions create a legally binding agreement between you and Tune Hotels.Com.
“cancellation charge” – RM 30 for any changes to your booking at anytime
“administration fee” – booking and administration fee
“bed” – Single size bed or Double queen size bed
“booking” – you place a definitive booking with payment
“café” – “Uncle John’s Cafe” situated on the Ground Floor
“cancellation” – when you cancel your booking with us
“check-in time” – 2.00 pm – 10.00 am
“check-out time” – before 10.00 am
“convenience store” – “My News” situated on the Ground Floor
“credit shell” – in event of cancellation of your booking within the stipulated notice period, this amount will be credited into your registered account to enable you to utilize it later
“double room” - 2 adults + 1 child (below 12 years)
“guests” – a customer at Tune Hotels.Com
“hotel” – Tune Hotels.Com
“Service tax and charges” – 5% service tax and 10% charges for room rate.
“locker” – allocated compartment to store personal belongings
“luggage room” – common space to store luggage
“multiple nights” – more than one (1) night
“rate” – price charged for your room
“real time” – a steady flow of new information without interruption occurring immediately
“reference print-out” – print out that we issue when your booking has been confirmed
“registered account” – account assigned to you upon your first booking with us
“security” – comprises security guards, CCTV, key lock system
“single room” – 1 adult + 1 child (below 12 years)
3. Tune Hotels.Com “No Frills” concept
l “No-frills” concept, all that is necessary and essential to ensure a good night’s sleep minus the “frills”
l Safe, clean and comfortable environment
l Excellent five star quality bed i.e Tune Bed by King Koil
l Clean en-suite bathroom with power shower
l All rooms come equipped with a fan
l Limited housekeeping services
l Friendly and helpful Tune Hotels.Com employees and staff
(a) All room reservations, enquires, or cancellations must be made online at www.tunehotels.com.
(b) Full payment for your accommodation must be made at the time of booking. All bookings will be charged to a valid credit card. For cash paying customers, the payment must be made to the stipulated account with proof of
payment within the time given or the booking is automatically cancelled. For walk-in guests, payment by valid credit card and/or cash.
(c) All bookings are subject to availability.
(d) When you first book with us, you will be registered as a “guest” of Tune Hotels.Com and you will be required to provide details of a credit card or cash option which will form part of your registration. We will open an account in
your name and all payments for bookings made by you will be shown as debits to your account. For future bookings, you may use the registered credit card (that has been previously registered on our system).
(e) Once your booking has been completed, a reference number will be issued which you should print. You should present this reference upon check-in at the Hotel, together with proof of your identity (NRIC/Passport) at the point
of check-in. The person named in the booking must be the person that will actually be staying.
(f) Your room will be held for your arrival until 1000 hours following the first night of your reservation - after which the booking will be deemed cancelled.
(g) Upon check-in, you will be required to pay a deposit of RM5.00 (this amount is to cover in the event your room keycard is not returned to us or it it’s damaged). At the time of check-out from Tune Hotels.Com, your deposit of
RM5.00 will be returned to you (minus (if any) any amount deducted for the above damage and/loss of Tune Hotels.Com property).
5. Room Rates
(a) Room rates shown on our website are per room per night on real time and exclusive of service tax and charges or tax at the prevailing rate and are payable in Ringgit Malaysia.
(b) The rate of the room (Single or Double) is dependant on the time of booking and the number of rooms available during that period. Room rates are based on real time and may vary by night at the same location.
6. Tune Hotels.Com rooms
(a) Tune Hotels.Com rooms vary between Single and Double, and vary depending on location. During the booking process, should the type of room you require not be available, then an alternative one will be displayed. Please
ensure that your booking reflects your requirement.
(b) Daily cleaning takes place between 1000 hours to 1400 hours. If for any reason our housekeeping staff are unable to enter your room during the first attempt, then cleaning will only take place the following day.
7. Check in and out times
(a) All Tune Hotels.Com operate on a strict arrival check in and check out policy.
l Check- In Time : 1400 hours
l Check-Out Time: 1000 hours
(b) If check-out is beyond 1000 hours, an additional one (1) night’s stay is subject to availability and an additional rate in real time will be imposed.
(c) Latest time of arrival is 1000 hours the following day. After that your booking is deemed cancelled.
8. Changes and Cancellations
(a) Once made, bookings are non-refundable.
(b) Any changes regarding the date, room category, duration of stay of your booking will require you to cancel your initial booking and re-book your stay.
(c) Any cancellation of your booking MUST be done/made forty-eight (48) hours before the 1400 hours check-in time on the day of arrival and your account with us will be re-credited with the amount you have already paid
with the cancellation charge being debited, and the net amount will then be held in your account with us as future payments for other accommodation booked through www.tunehotels.com. Any credits must be used within six
months of the date of change or cancellation, or will be deemed forfeited.
(d) For any cancellations of bookings within or after forty-eight (48) hours, the monies paid are deemed forfeited. Multi-nights bookings cancelled after forty-eight (48) hours will also be deemed forfeited.
9. Optional features in Tune Hotels.Com
For a minimal fee, you may opt for the following:-
(a) Air-conditioning is only upon request and charged as per usage – pay per use with key card obtainable at Reception Desk upon check in;
(b) Lockers – located at Ground Floor. Token system. Use and deposit of goods/valuables is at your own risk. All lockers are on a first come first serve basis and subject to availability;
(c) Amenity bag and towel can be purchased at Convenience Store on Ground Floor.
Tune Hotels.Com rooms do NOT include :-
(a) Room service, telephones, television, radio, a safe, wardrobe, bathrobe, soap and towels in bathrooms, mini-bar, tea or coffee making facilities in rooms.
(b) We do not provide additional or extra beds.
(c) No pets, livestock are allowed in Tune Hotels.Com.
10. Room key card
(a) All room keys must be returned to the Reception Desk upon check out. We will forfeit your RM 5.00 deposit (as a penalty) upon check-out if your room key card is not returned or if it is damaged.
(a) Only upon request and charged as per usage – pay per use with key card obtainable at Reception Desk upon check in.
(a) Located at Ground Floor. Use and deposit of goods/valuables is at your own risk. All lockers are on a first come first serve basis and subject to availability.
(b) Token system. Charges :– RM 2.00 per token. One (1) token is eligible for one (1) time use
(a) Tune Hotels.Com reserves the right to commence any legal action or proceedings in relation to any damage to done to the rooms or to the property.
14. Special requirements
(a) Tune Hotels.Com rooms are not built to cater to persons with special requirements.
15. Right to Refuse Accommodation
Tune Hotel.Com reserves the right to refuse accommodation to any person(s) and may terminate the booking or stop any event immediately without being liable for any refund or compensation under the following circumstances
(but not limited to) where:-
(a) such action is deemed necessary for reasons of safety or security; concern any unlawful activities, disturbance or which cause public nuisance which will effect the comfort of the other guests of the hotel;
(b) your conduct, status, age or physical condition or the physical condition of your luggage is deemed such as to, (i) may cause harm, discomfort or (ii) involve any hazard or risk to yourself or other persons or to our property;
(c) you have committed misconduct on a previous stay and such conduct may be repeated;
(d) the applicable rate or any charges or taxes payable have not been paid, the payment of your room rate is fraudulent (i.e using a fraudulent credit card), the credit card by which you paid for the rate has been reported lost or
stolen; the booking is counterfeit or fraudulently obtained;
(e) the booking of our Hotel Room(s) has been done fraudulently or unlawfully or has been purchased from a party not authorized by us;
(f) the booking has been altered by anyone other than us or our authorized agent or has been tampered with or defaced (in which case we reserve the right to retain such booking documentation); and/or
(g) you do not register as the person stated on the booking or the person checking in cannot prove that he is the person named as per the booking (we reserve the right to retain such booking documentation in such
16. Limitation on liability and law
l We are only responsible for your booking reservation and guarantee the same at the Tune Hotels.Com on your date of arrival as per the reservation and nothing more.
l We only warrant that the room, as described on our Site, will be available to you.
l We are not in a position to guarantee your safety against accidents, acts of God, theft, or even acts of negligence. All activities have inherent risks to health and safety and Tune Hotels.Com will not be responsible for
any eventualities related to services booked through this site.
l Whilst we make every effort to ensure that the material contained on the Tune Hotels.Com website is accurate, and all material published is in good faith, Tune Hotels.Com does not warrant or represent its accuracy
and disclaims to the maximum extent permitted by law all warranties expressed or implied by statute, custom or usage relating to the information contained in the website. Tune Hotels.Com will not be liable for any
direct, indirect, consequential losses or damage arising out of the use of this site or any errors, inaccuracies or omissions in materials provided.
l We reserve the right to retain your credit card details and you consent to us debiting such amounts for which you are responsible for as a result of and in the event any is damage caused to your Tune Hotels.Com room
by you or your guest during your stay. These amounts may be debited from your card without prior notification.
l We will not be held responsible for any loss or damage of property left in or damaged as a result of being in your Tune Hotels.Com room during your stay. We have no responsibility for any property left behind / damaged
as a result of your stay.
(a) The various linked sites on our Tune Hotels.Com site allows for further link-up and interaction between you and the said sites for promotions and other interactive mediums. The inclusion of all website links on our Tune
Hotels.Com site does not imply endorsement by Tune Hotels.Com of such linked sites, or any association with its operations. Tune Hotels.Com is not to be held responsible to either the said sites or you assessing the said linked
websites, and is further not responsible for the content of the said linked sites, and does not make any representations regarding the content or accuracy of materials on the said site.
(b) You are advised to obtain insurance to cover cancellation, curtailment, and loss of luggage, personal effects and money.
(c) The laws of Malaysia shall apply to the Tune Hotels.Com website and the Terms & Conditions therein and court proceedings relating thereto may only be commenced in Malaysia.
(d) Statutory Requirements
The hotel is subject to statutory controls, including those relating to fire, licensing, entertainment, health, hygiene and safety. These must be strictly observed by you, your guests and/or representatives at all times throughout
your stay at the Hotel.
17. Data Protection
(a) We will retain all personal information which you provide. We may need to pass this information to other parties such as our licensees and it may also be required to be provided to security and/or credit checking companies,
credit and debit card companies, government and enforcement agencies and public authorities if so required, or as required by law. This may involve sending your personal information between different countries.
18. Trade marks, etc
(a) The material on the Tune Hotels.Com website is the property of Tune Hotels.Com. You may download or use the material on the website for your own non-commercial, private use. Otherwise, the material may not be
reproduced, published, distributed, amended, downloaded or otherwise used unless you have obtained tunehotels.com prior permission in writing.
(b) All trade marks, marks, materials used on the Tune Hotels.Com website directly linked and associated to the Tune Hotels.Com are owned by the Tune Group.
(a) Tune Hotels.Com reserves the right to cancel, amend or vary at any time the arrangements featured on the Tune Hotels.Com site without prior notice.
(b) Conflict Between English Text And Other Language Text
If there is any conflict or discrepancy between the English text of terms and conditions of this Agreement and any translation thereof, the English text shall prevail.
